The 'Desperate Housewives' star - who owns a stake of Los Angeles eatery Beso - is to be subjected to a lawsuit after a diner allegedly slipped on the floor and injured herself while celebrating her birthday.

According to legal documents filed in the Los Angeles County Superior Court, Luiza Boyadjian claims when she got up from her chair she "suddenly slipped and fell due to the floor being extremely slippery".

Suing the restaurant for unspecified damages greater than $25,000, the claimant maintains is was the owner's duty to ensure the floors are safe and as a result, she has suffered "major physical injuries" including "damage" to her nervous system.

JT Torregiani, a managing partner for Beso, told TMZ.com: "The company hasn't had a chance to review the lawsuit yet. Also, the restaurant is not aware of any incident of this nature happening in the past."

However, his isn't the first time one of Eva's restaurants has run in to trouble.

The Las Vegas branch of Beso - of which the star owned a 32 per cent stake - filed for bankruptcy earlier this year after losing up to $76,000 a month and owing $1.8 million to landlords Crystals.
